Gorran Haven Holidays Terms & Conditions

Please read these Terms & Conditions carefully. Your booking and deposit for a holiday constitute acceptance of them.

1. BOOKING
You enter into a contract, and become subject to these terms and conditions, with Gorran Haven Holidays when we receive your deposit and confirm your booking. When you make the booking, you warrant that you have the authority of all persons in your party to book on their behalf, and will indemnify Gorran Haven Holidays against all loss and damage arising directly or indirectly, from any act or default by yourself or any person or animal accompanying you or part of your party booking. Bookings are not transferable. We reserve the right to correct an error in the brochure price until your account is paid in full.

2. DEPOSITS & PAYMENTS
A deposit of 30% of the total holiday cost is payable on all bookings. A provisional booking
(a booking for which no deposit has been received) is held for seven days and will only become a booking on receipt of the 30% deposit. The balance is payable no later than eight weeks from the commencement of the holiday and cancellation does not remove this liability. Reminders are not sent and if the balance is not received within eight weeks from the commencement of the holiday the booking will deemed to be in default, the apartment(s) will be made available and action may be taken to secure the outstanding monies.

3. CARE OF PROPERTY:
It is a condition of acceptance of any booking that the holidaymaker will take good care of the property, its contents and fittings and ensure that it is left in a clean and tidy state as it will have been found. The care is to include all furnishings, utensils, crockery and linen and though you might not be charged for minor breakages, you are responsible for all damage or breakages. Gorran Haven Holidays retains the right to charge for any breakages or for any additional cleaning that may be required if the appartment are not left in a clean state.

4. ARRIVAL & DEPARTURE
You may arrive on site anytime between 3:00pm - 10pm on your day of arrival but if after 6:00pm please inform us so we may make arrangements with you. The apartment must be vacated by 10am on the day of departure.

5. COMFORT & SAFETY OF GUESTS
Our guests visit Gorran Haven to enjoy the peace and tranquillity. If anyone does not respect this, they may be asked to leave at any time. We reserve the right to decide whether to accept, reject, or retain any guest on the basis of general behaviour who is likely to, or does, infringe on the rights, welfare, or enjoyment of others. We also reserve the right to decide whether to accept, reject, or retain any guest who, because of behavious poses a direct threat to the health or safety of others

6. SERVICES, FEATURES AND FACILITIES
There will be certain facilities available which are not owned and/or operated by Gorran Haven Holidays where youmake a separate booking with the operator direct. Such facilities are not offered Gorran haven Holidays and we cannot be responsible for any injury, loss or damage that may result from your using such facilities. Information about facilities or services are to the best of our knowledge and belief, accurate at time of publication of the Information folder or website, but some of these facilities and services may not be available at the time you take your holiday. We have one vehicle space in order that one vehicle may be parked within the parking boundaries. Parking is entirely at the holidaymaker's own risk and no liability is accepted for any loss, damage or injury howsoever caused. Gorran Haven Holidays is situated in a country environment, and we cannot, and do not, accept responsibility for any damage or inconvenience caused by wildlife. This includes, but is not limited to, chickens, ducks, geese, goats, pigs, sheep and any deer and wildlife which may live nearby .

7. CIRCUMSTANCES BEYOND OUR CONTROL:
If for any reason beyond Gorran Haven Holidays control, the apartment is not available or has been rendered unsuitable for holiday letting (e.g. fire damage) on the date booked, we will attempt to find alternate accommodation and/or alternate dates or offer a refund of all monies paid by the holidaymaker. There shall be no further claim against Gorran Haven Holidays .

9. AMENDMENTS
Amendments, if we are able to satisfy these, are subject to a £12 administration fee. Within 7 days of the holiday, amendments will only be made in exceptional circumstances and in any case at the discretion of Gorran Haven Holidays . Amendments are not accepted after your holiday has started.

10. BABIES/YOUNG CHILDREN
Babies m
ust be supervised at all times by an adult and must not be permitted to wander around unaccompanied or unsupervised, this includes, but is not limited to the grounds themselves

11 NUMBER OF PERSONS & VISITORS
The number of adults using the apartment is not to exceed the maximum number stated, unless prior agreement has been reached. We reserve the right not to accept a booking or refuse entry if any of the booking conditions are not met. Permission for of any additional guests, or day visitors, arriving during a holiday must be sought prior to their arrival, full details must be given and visitors are only accepted at our discretion.

12. BROCHURE INFORMATION & FACILITY FAILURES :
It is our aim to ensure that the information given is accurate. However, Gorran Haven Holidays cannot be held responsible for changes which may occur after the brochure/website is published. We cannot and do not accept liability for a breakdown of any facility at Gorran Haven Holidays which is beyond our reasonable control (e.g. breakdown or failure of any electrical equipment, facility or plumbing) or from any misuse or negligence of the guest using Gorran Haven Holidays equipment or facilities resulting in loss, injury or accident.

13. LIMITATIONS OF LIABILITY:
The use of holiday accommodation, equipment and all/any facilities is entirely at the holidaymaker's own risk and no liability is accepted for any loss, damage, sickness or injury howsoever caused which may be sustained during the holiday to any member of the party, or any vehicle, its contents or any possessions of the holiday maker.

14. ACCESS:
The owners and/or their representative shall be allowed access to the property at any reasonable time during your holiday.

15. MINIMUM AGE
We can only accept bookings for parties where there is at least one person aged 21 years or over in the party and we reserve the right to refuse all single sex parties.

16. CREDIT AND DEBIT CARD PAYMENTS
Owing to the charges levied by card operators we do not accept these.

17. SMOKING POLICY
We are aware of the difference of opinion between smokers and non-smokers, particularly in close quarters and do not permit smoking in the property.

 

18. VAT
We are not currently VAT registered so the prices quoted are the total amount payable. However as VAT rates are subject to Government legislation, prices may therefore change if VAT thresholds or rates are altered.

19. COMPLAINTS
It is our aim that everyone should have an enjoyable holiday. Nevertheless, should you have cause for complaint, please advise us immediately, as once a holidaymaker has returned home it is difficult for us to investigate complaints of any nature.

20. CANCELLATIONS
Cancellations must be formally notified in writing by booking signatory name and sent to Gorran Haven Holidays, Alba, 24 Perhaver Park, Gorran Haven, Cornwall, PL26 6NZ. If a cancellation is for a holiday commencing more than eight weeks from the date of cancellation then the deposit will be forfeited and 70% of the total cost refunded. When a holiday is cancelled less than eight weeks from the commencement of the holiday the total holiday cost will be retained unless our Holiday Cancellation Security has been taken out. Gorran Haven Holidays, will make every attempt to resell a cancelled holiday and, if successful, may refund 70% of any successfully resold holiday.

HOLIDAY CANCELLATION SECURITY SCHEME
The cancellation scheme is for your protection and peace of mind. The scheme provides the hirer and the other members of their party, named on the form, a refund of monies paid (less a 10% administration fee and the Holiday Cancellation Security fee) in the event of cancellation prior to your holiday due to: serious illness; death; serious injury; jury service; cancellation of leave by HM Forces or HM Police; death, serious accident or serious illness of immediate family - husband, wife, child, father, mother, father-in-law, or mother-in-law.

The scheme is subject to the following terms:
1. Prior to and at the time of effecting the Holiday Cancellation Scheme you signature confirms:
(a) That you are not aware of any reason why the holiday should be cancelled or curtailed;
(b) That no person to be covered by the scheme is receiving or awaiting treatment as a hospital in-patient;
(c) That no person is travelling against the advice of their doctor or for the purpose of obtaining medical treatment or where a terminal prognosis has been given;
(d) That if you or any member of your party has received treatment as a hospital in-patient during the six months prior to booking you/they have obtained medical opinion as to the advisability of taking the holiday;
(e) No claims will be accepted for cancellations due to psychological or psychiatric disorders, anxiety, stress or depression.

A doctor’s certificate or other relevant documents will be required to support a claim.
If the Holiday Cancellation Security scheme is not taken out within seven days of a booking a refund will not be made.

PRICES AND WEB SITE ACCURACY - CHANGES AND ERRORS
Please note that holiday information and prices shown on our web site may have changed by the time you come to book your holiday. Whilst every effort is made to ensure the accuracy of the site and prices at all times, regrettably errors do occasionally occur. You must therefore ensure you check all details of your chosen holiday (including the price) with us at the time of booking. .
